Sponsor. The Sponsor of the Airbnb Shorts Contest (“Contest”) is Airbnb, Inc., located at 888 Brannan Street, San Francisco, CA 94103. The promotion is in no way sponsored, endorsed or administered by, or associated with Instagram or Sundance London.
How to Enter. Participants may enter the Contest beginning January 16, 2014 at 9:00am PST until January 29, 2014 at 11:59pm PST by creating an Instagram video on the theme of “inspiring people to travel to your city” and adding the hashtags #airbnbshorts and #(your city) to the video. In order for Airbnb to view entry videos and include them in the contest, your Instagram account must be set to permit public viewing during the contest period. Airbnb is not responsible for computer or network problems, problems with Instagram, or other submission errors that result in late or inadmissible entries. The video must be fifteen seconds or less in length. There is no limit on the number of entries participants may submit.
Eligibility. To participate or win, participants must be registered users of Instagram, at least 18 years old (or the age of majority in state of residence), and legal residents of the 50 United States or the District of Columbia. Directors, officers, employees, and agents of Airbnb, and the members of their immediate families or households, are not eligible to win.
Winner Selection. One (1) winner will be selected based on two (2) judging criteria applied to the entered videos at the following weight:
(1) How creative/original is it? (50%)
(2) How much local, in-depth knowledge of your city does it exhibit? How much does it make us want to visit? (50%)
Judges’ decisions are final and binding.
Prohibited Content. Videos must be created for the Contest, and not previously submitted in a past promotion or previously displayed publicly. Videos must be the original work of the participants and not violate the rights of any other party, including but not limited to intellectual property rights or rights of privacy/publicity. Videos must NOT contain: (a) advertising or commercial content for any party other than Airbnb; (b) content that endorses/promotes illegal or harmful activity; (c) violent, profane, vulgar, obscene, defamatory or otherwise objectionable material; or (d) adult material. Airbnb reserves the right to disqualify any video that violates these prohibitions, or any video Airbnb deems inappropriate for any reason, in Airbnb’s sole discretion.
License. By submitting a video or videos, participants grant Airbnb an unrestricted, perpetual, worldwide, royalty-free, non-exclusive license to reproduce, distribute, transmit, publish, display, or otherwise use the video or videos (including in conjunction with participant’s likeness, photo, name, and/or geographical and biographical information), with or without modifications, in any media, whether now existing or later developed, for any purpose. To the extent a video includes the likeness of a person other than the participant, the participant must provide proper permissions in a form acceptable to Airbnb.
Notification/Announcement of Winner. Airbnb will notify the first-place winner through the Instagram or other messaging methods between February 1 and February 4, 2014. If such winner fails to respond within four days, he or she may be disqualified, and the Prize may be awarded to an alternate winner. In the event of a dispute about the identity of the winner, Airbnb will award the Prize to the authorized account holder of the Instagram account associated with the winning video. Airbnb will publicly announce the winner within 7 days of the close of the contest period, including through social media channels such as Twitter (@Airbnb) and Facebook (https://www.facebook.com/airbnb).
Prize Conditions. The prize is provided as-is with no warranty or guarantee. All federal, state, and local laws and regulations apply, including but not limited to tax laws. The winner must provide Airbnb with a valid taxpayer identification number before any prize will be awarded. The winner will receive an IRS Form 1099 at the end of the calendar year. Airbnb may require the winner to sign and return an affidavit of eligibility, a liability release and a publicity release where permitted by law. In Airbnb’s sole discretion, refusal or inability to sign and return such forms within four days of notification may result in disqualification and the selection of an alternate winner. The winner must be, or must become, a registered user of Airbnb to redeem the Prize. Registration is free.
General Liability Release. By entering the Contest, participants release Airbnb, Pereira & O’Dell LLC, Instagram and Sundance Institute from any liability whatsoever, on any theory, and waive all claims and causes of action arising from or related to this Contest.
Interpretations and Disputes. Participants agree to be bound by these Rules and all decisions of the judges, which are final and binding. Any disputes shall be governed by the laws of the State of California, and shall be resolved in the courts of San Francisco, California.
Miscellaneous. The Contest is void where prohibited. If any terms or provisions of these Rules are held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall continue in full force and effect. Airbnb may suspend, modify or terminate the Contest if it believes, in its sole discretion, that malfunction, error, disruption, or damage is impairing or will impair the administration, security, fairness, integrity, or proper conduct of the Contest, in which case the Prize will be awarded among the eligible entries received that were unaffected by the problem, if possible.
